If it be taken, without evidence, that he is a headman, constable, or peace otficer duly appointed by, or under authority from, the Governor, within the scope of clause 7 of Ordinance No. 4 of 18'_1l, then by force of that enactment, coupled with clause 110 of Ordinance No. ll of 1868, it n0 doubt became his duty, when Markandu accused the complainant of theft to him, to apprehend PRINTED BY W. Vol. II., No. 31.-121 the complainant, and fortkmitk to take or send him with a report stating the date of, and the reason for, the arrest, and all that had been done upon_'the occasion to the police court of the place wherein he was apprehended. A limit or qualification to this word, forthwith, has been put by clause 167 of Ordinance No. 11 of 1868, which-enacts that, " No person shall in any case, under any pretence whatsoever, be kept or detained in confinement for a longer period than twenty-four hours by any officer authorized to apprehend offenders, unless hunday or some public holiday intervene, without being taken before some competent justice or police magisrate." And, inasmuch as it appears to be established by evidence in the case, that the 13th, 14th, and 15th April were, the first a Sunday, and the two others public holidays, it would seem that Malhami, by taking the complainant whom he had arrested on the 13th, before the police magistrate on the 16th, did so under the circumstances of the case, "forthwith" within the meaning of clause 7, of ()rdinance No. 4 of 1841.
